Colorado Association of REALTORS® Legal Hotline Terms and Conditions Agreement

Who May Access the Hotline (“Authorized User”)

The CAR Legal Hotline (“Hotline”) is an education resource available to currently active Colorado REALTOR® members who are licensed by the State of Colorado as an Employing Broker and serving in such capacity for their brokerage firm.  Individuals who are licensed by the State of Colorado as an Independent Broker and acting in that capacity may also use the Hotline if they are active Colorado REALTOR® members.  The Hotline may also be used by active Colorado REALTORÒ members who are licensed by the State of Colorado as an Associate Broker, but only if they have been explicitly authorized by their Employing Broker to utilize the Hotline.

No other individuals are authorized to access the Hotline.

Limited Purpose of the Hotline (“Hotline Limited Purpose”)

The Hotline is an education and legal information service only.  It is provided in connection with the Association’s mission to provide real estate related education to its members. The Hotline’s purpose is to keep REALTORÒ members informed on real estate market developments, industry best practices, and current issues impacting real estate brokerage in Colorado.

The Hotline provides real estate related legal, business, and transactional information only. It is not a substitute for legal advice. No attorney-client relationship is created between any caller and the Hotline attorney. Communications to and from the Hotline are not confidential or privileged. 

Limitations of Hotline Use (“Hotline Use Restrictions”)

The Hotline will not send or receive emails or any other correspondence to or from Authorized Users. 

The Hotline does not review or draft specific language for contracts or other documents on behalf of Authorized Users or their clients.

The Hotline will not provide analysis of any potential claims or complaints that may be filed in any court of law, regulatory agency, or in the REALTORÒ Professional Standards enforcement process (REALTORÒ Code of Ethics or REALTORÒ Arbitration).

The Hotline does not create or maintain any record(s) of individual parties, specific names, details, or circumstances involved in the information it receives or provides to any Authorized User.

Authorized Users agree that they will not misrepresent the content of any Hotline discussion(s) to clients, customers, or other licensees in a manner that implies they received legal advice from the Hotline or that the Hotline is acting in the capacity of their legal counsel.

Authorized Users agree to not make use of any recording or other electronic note-taking devices during a Hotline call.

Hotline Management and Administration (“Hotline Administration”)

CAR offers the Hotline to Authorized Users through a contract with Legal Information Services, LLC (“LIS”), a third-party legal education vendor.  Pursuant to that contract, LIS provides Authorized Users with access to attorneys licensed in Colorado with specific experience in real estate. Although callers speak directly with licensed attorneys, these communications are not privileged, confidential, and do not establish an attorney-client relationship, either express or implied.  Any information provided is for educational purposes only and specifically not “legal advice.”

Hotline Waiver of Claims & Terms and Conditions Updates (“Hotline Waiver and Terms of Use Updates”)

CAR and LIS make no representations or warranties to Authorized Users, their brokerage firms, or their brokerage firm’s real estate clients regarding the accuracy of any education and information provided through the Hotline.  Authorized Users expressly waive any claims against CAR and LIS for any liability or damages that may arise based on the Authorized User’s use of the Hotline.

CAR and LIS reserve the right to amend, modify, or replace these Terms and Conditions at any time, in their sole discretion. Any such changes shall be effective upon posting on the CAR website.

By continuing to access or use the Hotline after such modifications are posted, you agree to be bound by the updated Terms and Conditions. If you do not agree to the modified terms, you must discontinue use of the Hotline service.

Hotline Hours of Operation (“Hotline Hours”)

The Hotline is available Monday through Friday, 9:00 a.m. to 12:00 p.m. and 1:00 p.m. to 4:00 p.m. Mountain Time. The Hotline is closed during the lunch hour, on weekends, and holidays. Messages left outside of operating hours or by individuals not authorized to use the Hotline will not be distributed to a Hotline attorney and the call will not be returned.


Authorized User Acknowledgment

By accepting these Terms and Conditions, I affirm that:

  • I qualify as an Authorized User and am an active REALTOR® member of the Colorado Association of REALTORS®
  • I have reviewed and acknowledge the Hotline Limited Purpose
  • I have reviewed and agree to abide by the Hotline Use Restrictions
  • I have reviewed, acknowledge and understand the Hotline Administration
  • I have reviewed, acknowledge and consent to the Hotline Waiver and Terms of Use Updates
  • I acknowledge the Hotline Hours of Operation
